Terms of Service

1. Acceptance of Terms

By accessing or using the Planes.FYI website, iOS application, or any related mobile applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date above. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.

2. Description of Service

Planes.FYI is a flight tracking and aviation information platform that provides live aircraft tracking, airport data, weather information, and related features. The Service is available through the web at planes.fyi and through mobile applications.

3. Disclaimer — Not for Operational Use

The Service is for entertainment and educational purposes only.

The information provided through the Service is not intended to be used as a resource for flight planning, navigation, air traffic control, or any operational aviation purposes. Data displayed on the Service may be inaccurate, incomplete, delayed, or otherwise unreliable. You must always consult official aviation authorities, certified flight planning resources, and approved navigation tools for any actual flight operations.

Planes.FYI is not an air traffic control service, flight planning tool, or aviation safety system. Do not make any aviation-related decisions based on information provided by the Service.

4. User Accounts

To access certain features of the Service, you may need to create an account. When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate your account at our discretion, including for violation of these Terms.

5. Premium Subscriptions

5.1 Billing and Payments

Planes.FYI offers optional premium subscriptions with additional features. By subscribing to a premium plan, you agree to pay the applicable fees. Payments are processed through third-party payment processors (Stripe for web, Apple for iOS in-app purchases). All fees are stated in the currency displayed at the time of purchase.

5.2 Recurring Billing

Premium subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

5.3 Cancellation

You may cancel your premium subscription at any time. For web subscriptions, you can cancel through your account settings. For iOS subscriptions, you must cancel through your Apple ID subscription settings. Upon cancellation, you will retain access to premium features until the end of your current billing period.

5.4 Refunds

Refund eligibility depends on the payment platform used. For iOS in-app purchases, refunds are governed by Apple's refund policies. For web subscriptions processed through Stripe, refund requests may be considered on a case-by-case basis by contacting us at info@planes.fyi.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to interfere with, compromise, or disrupt the Service or its infrastructure
• Scrape, crawl, or use automated means to access the Service without our written permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Circumvent any access controls, rate limits, or security measures
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use the Service to track aircraft for purposes of harassment, stalking, or any activity that threatens the safety or privacy of others
• Resell, redistribute, or commercially exploit the Service or its data without our written permission

7. Intellectual Property

The Service, including its design, features, code, graphics, and content (excluding third-party data), is the property of Planes.FYI and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

Flight data, airport information, and other aviation data displayed on the Service may be sourced from third parties and is subject to their respective terms and licensing.

8. Third-Party Data and Services

The Service incorporates data from third-party sources including, but not limited to, ADS-B data providers, mapping services, and weather data providers. We do not guarantee the accuracy, completeness, or reliability of any third-party data. Third-party data is provided "as is" and may be subject to additional terms and conditions from the respective data providers.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Planes.FYI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to, use of, or inability to access or use the Service
• Any reliance on information provided through the Service
• Any unauthorized access to or use of our servers or any personal information stored therein
• Any interruption or cessation of the Service
• Any errors, inaccuracies, or omissions in the data displayed on the Service

In no event shall our total liability to you for all claims arising from or related to the Service exceed the total amount, if any, that you have paid to us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any information provided through the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless Planes.FYI and its operators, affiliates, officers, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any rights of a third party

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts of the Province of Ontario, Canada, and you consent to the exclusive jurisdiction of such courts.

13. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.

15. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
